(CNN) The five teenagers who mocked a drowning man when they recorded his death in Florida will not face charges because they were not required by law to help.

Police said a video recorded last July showed teens between the ages of 14 and 19 laughing as Jamel Dunn, 31, struggled to stay afloat in a pond near his family’s Cocoa home.
The teenagers mocked the man, saying that he would “die” and said that they were not going to help him. Instead, the teens giggled as they recorded the victim’s last moments and posted the videos on YouTube.
During a subsequent interview, the teens confessed to “smoking weed,” police said.
The Cocoa Police Department has advised the state attorney’s office to charge the group with non-reporting of death.
But prosecutors announced last week that the group would not be prosecuted.
